Q. What should the supervisor do if the employee refuses to complete the Employee Injury Statement Form?

A. The supervisor should complete the form and forward the original to the EIM Office and attach a note indicating the employee is refusing to complete the form.

Q. Should the supervisor report an injury/illness if he/she does not feel the injury being reported is in the course and scope of employment?

A. YES. The injury still needs to be reported. Compensability will be determined by the insurance adjustor.

Q. Should an injury/illness be reported to the Employee Injury Management Office if an employee does not wish to seek medical attention?

A. YES. The job-related injury/illness will be recorded in the Employee Injury Management Office as an occurrence. If the employee elects to seek medical attention at a later date, the employees needs to notify the Employee Injury Management Office.

Q. Is time taken off for appointments with the doctor or physical therapist considered lost time?

A. NO. Lost time is that period of time during which the injured employee is physically unable to work due to a compensable injury.

Q. Is an employee required to use all of his/her accrued sick leave before he/she is entitled to receive workers' compensation benefits?

A. Yes. In accordance with the Texas Workers' Compensation Act, if an employee elects to use paid leave, they must first EXHAUST ALL ACCRUED SICK LEAVE.  Once sick leave is exhausted, the employee may then choose to use one or more weeks of other paid leave in lieu or receiving Temporary Income Benefits or be placed on leave of absence.
