Grievance and Appeals

Employee Relations is responsible for ensuring compliance with state and federal regulations and institutional policies and procedures. The division facilitates the mediation, grievance and appeals processes and also investigates allegations regarding illegal discrimination, retaliation and sexual harassment.

How do I file a grievance or an appeal?

In accordance with IHOP Policy 3.1.10 Grievance Policy, any employee may file a grievance to present a complaint related to wages, hours of work, working conditions, merit raise, job assignments, performance evaluation, unlawful discrimination, reprimand or the interpretation or application of a rule, regulation or policy. The affected employee must submit a written request to Employee Relations. The request must be made within 10 working days following the date of the action. The failure of the employee to submit the grievance in a timely manner irrevocably waives his or her grievance rights.

In accordance with IHOP Policy 3.1.9 Discipline, Dismissal and Appeal for Classified Employees, disciplinary actions resulting in dismissal, suspension without pay or demotion may be appealed by the affected employee by submitting a written request for a hearing to Employee Relations. The request must be made within 10 working days following the date of the disciplinary action. The failure of the employee to submit the appeal in a timely manner irrevocably waives his or her appeal rights.

How do I request mediation?

Mediation is an alternative form of dispute resolution involving an impartial third party, or mediator.

The third party facilitates communication between the employees involved in a conflict or dispute to promote reconciliation, settlement or understanding of differing viewpoints. Mediation is a voluntary process in which both parties must agree to participate.

Where do I file a complaint of unlawful discrimination, retaliation or sexual harassment?

UTMB, in compliance with applicable federal laws and regulations, strives to maintain an environment free from discrimination against individuals on the basis of race, color, national origin, sex, age, religion, disability, sexual orientation, gender identity or expression, genetic information or veteran status. This includes all programs, facilities or services and applies to all employees and students, and anyone who utilizes UTMB facilities.

In addition, UTMB is committed to providing a work and learning environment that is free from inappropriate conduct that is sexual in nature. Sexual misconduct and sexual harassment in any form, including sexual violence, relationship violence and stalking, will not be tolerated. The institution also prohibits retaliation against employees who report allegations of unlawful discrimination and/or harassment or who participate in an investigation.

If you believe you are being subjected to any behavior which is prohibited by the institution’s policies and procedures, please report the incident to any member of UTMB’s management, Human Resources or the Department of Internal Investigations. Allegations of sex discrimination, including sexual harassment, sexual violence, relationship violence and stalking, can be reported directly to the Title IX Coordinator.
